South Dakota 2026 Legislative Update – Week 5

Prenatal Education Bill Advances to the Senate

HB1313 is an Act to require education in prenatal human growth and development.

HB1313 would require our school education standards to show a video showing human growth and development. It must be age-appropriate, at least three minutes long, and be part of either a science or health class.

The “Baby Olivia” video was presented to the committee as an option for each school to choose. This video shows the beautiful development of human life in a fact-based manner. Students learn about plant and animal development, so why shouldn’t they learn about human development as well?

Position: Support

Status: We are pleased to report that HB1313 passed in the House on February 12 with a vote of 52-10-8 and now moves to the Senate. Check the votes here.

Constitutional Convention a.k.a. “Convention of States”

SCR503 is a resolution applying to Congress for a Constitutional Convention. Having a Constitutional Convention would put the U.S. Constitution at risk of revision. A much safer method of amending the Constitution is the traditional amendment process, which has successfully added 27 amendments without jeopardizing the document as a whole.

Supporters argue that SJR 503 would impose fiscal restraints and rein in the federal government, but the Constitution already provides these restraints. If lawmakers would simply follow the Constitution, all of these issues would be resolved. If they don’t obey the Constitution now, would adding another amendment make a difference? “We the People” must hold our lawmakers accountable to the oath they took to the Constitution.

After passing in the Senate, SCR503 was heard in the House State Affairs Committee this week. It failed to get a majority vote and was sent to the 41st Legislative Day, essentially killing the bill. We wanted a Yes vote to kill the bill. Check the votes here.

Position: Oppose

Status: There will be an attempt on Tuesday, February 17, to “smoke” SCR503 out of committee for a full House vote. If the “smoke out” is unsuccessful, the resolution is defeated, and the process is complete. However, if it is “smoked out,” it will be voted on in the House.

ACTION:

  • Contact your two representatives and urge them to OPPOSE THE SMOKE OUT AND OPPOSE SCR503.
  • To find out who your two representatives are, go here. Then, to find out how to contact them, go here.
  • When emailing, include your district number in the subject line so they know you are from their district.
  • Be sure to let them know that you are a member of Concerned Women for America of South Dakota. The more legislators hear from us as an organization, the greater our influence will be as we lobby legislators at the Capitol.
  • Please forward this e-alert to others today and ask them to pray and take action.

Conscience Protection for Healthcare Providers

We are disappointed that HB1153 was defeated in the full House with a vote of 24-41-4. Check the votes here.

HB1153 would have protected certain rights of healthcare providers. It was intended to shield health care professionals from penalties or coercion for refusing to provide medical care that conflicts with their conscience.

Protection of the Innocence of Children

We are disappointed that HB1116 was defeated in the full House 23-43-4. Check the votes here.

HB1116 would have prohibited children’s streaming shows from inappropriate ads that promote abortion, alcohol, drugs, gambling, gender transition, and nicotine.

PRAY:

Father, we are grateful for the men and women who serve in our legislature. Please give them wisdom concerning every decision they make. Bless them and their families with peace and rest in You. In Jesus’ name. Amen
