Kansas Supreme Court to Decide on Abortion

Remember the Unborn Child Protection from Dismemberment Abortion Act that Gov. Brownback signed into law in 2015?

As we expected, it has been challenged all the way to the state Supreme Court.

During this case’s journey through the courts, one of the liberal activist judges, Shawnee County District Judge Larry Hendricks, declared that the Kansas Constitution says there is a legal right to abortion. However,  the Kansas Supreme Court has never held that the Kansas Constitution says that there is a legal right to an abortion. The word “abortion” doesn’t even appear anywhere in the state constitution!

The Kansas Supreme Court could overturn the appellate court decision and uphold the ban on dismemberment abortion; however, the composition of that seven-justice court makes this outcome unlikely. Former Gov. Kathleen Sebelius appointed four of the justices, which is enough to declare by judicial fiat that abortion (not life) is a constitutional right.

This “legal right to an abortion” will be decided in the Kansas Supreme Court very soon.
