Election Alert: Amendment 4 – How Will Your Vote Affect Abortion in Florida

Election day is drawing closer. There will be a variety of measures on Florida’s ballot this year. Now is the time to familiarize yourself with them.
 
In particular, Concerned Women for America (CWA) of Florida would like to provide an analysis of Amendment 4 and how it will affect abortion in Florida. It’s very simple.
 
Ballot Title: Amendment to Limit Government Interference with Abortion
 
Ballot Summary: No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider. This amendment does not change the Legislature’s constitutional authority to require notification to a parent or guardian before a minor has an abortion.
 
In Short:

  • A “YES” vote will change Florida’s constitution to allow abortion within all nine months of pregnancy and eliminate parental consent.
  • A “NO” vote opposes a change to the state constitution regarding abortion.

 Extended Analysis:

  • “No law shall prohibit, penalize, delay, or restrict…” = Will overrule current law.
  • “No law shall…restrict abortion before viability or when necessary to protect the patient’s health” = because “health” can be interpreted as physical, mental, emotional, and financial health, this opens the door to abortion within all nine months.
  • “…determined by the patient’s healthcare provider.” = Will not require a physician to decide. According to state law, chiropractors, massage therapists, and athletic trainers are considered “health care providers.”
  • “…require notification to a parent…” = Will only require notification, not consent. Will make this the only medical decision in Florida for which parents have no say.
