Who Will be Held Accountable for the Government’s Collusion with Big Tech to Violate Constitutional Rights?

The days of speculating about the decision-making process of social media giants like Google, Facebook, Twitter, and YouTube are over. Although many conservatives could smell the garbage a mile away, given that the censorship was overwhelmingly against conservatives and to help liberals, the release of the now-infamous Twitter Files, reveals deep coordination between the government and the giant tech company to suppress speech the government considered detrimental to its preferred causes.

 

 

Far from what the left has been saying for years, “This is a private company, so it can do whatever it wants,” the fact is that Twitter was not acting of its own accord in many instances but at the behest of the federal government.

 

 

In other words, the government was seeking to suppress speech by proxy. Knowing its actions would be met with First Amendment restrictions if done directly, it pressured social media companies (all of them, not only Twitter) to perform the unconstitutional actions at their behest.

 

 

Journalist Matt Taibbi who has led the coverage of the Twitter Files, concluded, “The files show the FBI acting as doorman to a vast program of social media surveillance and censorship, encompassing agencies across the federal government – from the State Department to the Pentagon to the CIA.” The liberal media will certainly try to downplay these findings, but this is explosive, uncontroverted evidence of unconstitutional actions at the highest level of government.

 

 

The problem gets even more nefarious when one considers that the reason liberal Twitter executives played along, despite clear reservations that they were acting improperly, was that the FBI was working to help the political party both entities favored, the Democrats. 

 

 

The Hunter Biden-“Russia misinformation” fiasco is the most clear-cut case of how they sought to affect the elections to favor one party by spreading lies and suppressing legitimate speech on social media. Recall Twitter went so far as to censor the oldest continually published daily newspaper in America, The New York Post, because of its coverage of the Hunter Biden laptop. Twitter banned the distribution of a legitimate news story linking then-presidential candidate Joe Biden to his son’s dubious business relationships abroad.

 

 

It’s been reported that the FBI actually paid Twitter almost $4 million to ban accounts and suppress speech that primarily targeted conservative voices. They even established an exclusive, private channel of communication that gave them direct access to where they would be in communications daily.

 

 

This is why it is such good news that the new House Republican Majority voted this week to establish a “Select Subcommittee on the Weaponization of the Federal Government” modeled after the 1970’s “Church Committee” led by Democrat Sen. Frank Church which investigated intelligence abuses by the executive branch. Rep. Jim Jordan (R-Ohio) is expected to chair the new committee looking into today’s abuses.

 

 

I write to inform you of these developments and ask that you pray for Rep. Jordan and the new committee. They face a monumental task that will require the sort of assistance that is beyond all human control. Let us earnestly seek the intervention of the same hand of Providence that has guided our nation throughout our history.

 

 

We stand at a crucial moment in our history. Trust in our government and all our institutions is quickly disappearing. But this good-faith trust is essential to the survival of our Republic. 

 

 

Therefore, we must demand accountability as the number one priority for this new Congress. Unfortunately, these inquiries have too often led to minimal action when it is all said and done. That cannot happen in this case— for the good of the nation.

Unprecedented Raid-CWA Responds

Enough is enough. The unprecedented raid of the personal residence of former President of the United States Donald J. Trump strikes at core foundational principles of liberty. Americans, regardless of political persuasion, must stand against it. The Federal Bureau of Investigation (FBI) must be held accountable for these destabilizing and seemingly politically motivated actions against the political opponent of the current Administration.

 

But congressional accountability will not happen without our voices demanding the sort of bold action that this historic moment demands. We need to band together to make our voices heard.

 

This is not a time for the faint of heart. Many may shy away from the big bureaucratic state, with its promise of many more IRS agents in the near future, but with your help, Concerned Women for America (CWA) will not back down. We will fight for your rights and stand up to their abuses, as we have done before.

We have stood up to Big Government before. CWA was audited by the IRS during the Clinton years, coming out of the ordeal stronger than ever. And just last year, when reports of the FBI’s unjust targeting of CWA surfaced, we immediately stood up to their abuses, prompting senators into action.

 

We will not be bullied. And that is why the voice of conservative women standing together is so crucial now that the Department of Justice (DOJ) and the FBI seem to be prioritizing their work by political persuasion. We saw it with the targeting of parents at school board meetings as “domestic terrorists,” and we are seeing it now with this abuse of power in what is allegedly a record dispute.

 

If we allow this sort of action to go unaccounted for, there is no question that escalation and manipulation of government agencies for political gain will only increase in the years to come, putting all our liberties at risk.

 

Please, consider giving sacrificially to make sure we can present a robust challenge to these unprecedented attacks. And continue to pray for our nation.

AG Garland Defends Intimidation Actions

AG Garland Defiantly Defends Action to Intimidate Parents Speaking Out at School Board Meetings 

Attorney General Merrick Garland appeared before the Senate Judiciary Committee this week for an “oversight hearing” of his leadership at the U.S. Department of Justice (DOJ).  Out of the gate, Republican Senators took the opportunity to question him intensely on his October 4 memorandum to the Federal Bureau of Investigation (FBI) in which he cites “a disturbing spike in harassment, intimidation, and threats of violence against school administrators, board members, teachers, and staff who participate in the vital work of running our nation’s public schools.” When pressed, Garland admitted he had no evidence of these charges beyond news reports that he failed to investigate.

As a paper trail of communication has uncovered,  AG Garland’s memo was undeniably a coordinated response to a request for action from the National School Boards Association (NSBA) in a letter to President Biden that likens the actions of engaged parents as “the equivalent to a form of domestic terrorism and hate crimes.”

Lost on no experienced advocate is the chilling effect this threat from the nation’s most powerful law-enforcement apparatus will inflict on parents trying to stand up for their rights as taxpaying citizens and the safety and protection of their children in schools. Concerned Women for America immediately sent a letter to Attorney General Garland when he issued his directive, reminding him that parents are sovereign in raising and educating their children and their grievances are protected speech, not an excuse for federal investigation.

While he repeatedly identified “spirited debate” and disagreement over school policy and curriculum as a First Amendment right, Garland defiantly defended the tone and content of his memo to the FBI, refusing to recognize the rightful concern such a call for federal law enforcement engagement in local schools has raised.  Even in the aftermath of NSBA retracting the aggressive language in its letter—catalyzed by school boards in Missouri, Ohio, and Pennsylvania making high-profile exits from the association—Garland doubled-down and rejected any call for withdrawing his decree.

AG Garland’s appearance before the Senate came on the heels of his testimony before the House Judiciary Committee. During that hearing, Democrat Chairman Jerry Nadler refused a request from Republicans to air a revealing video compilation of courageous moms and dads speaking at school board meetings and pleading with local authorities to hear and respect their concerns. Censoring this video for a public hearing begs the question: Why are Democrats bent on suppressing the voices of parents? Perhaps they fear what this exposure really means about their morally destructive agenda.

Before the government-mandated closures of COVID-19, many parents had no idea what was being peddled in the classrooms. When parents were forced to become home-based substitute teachers, they were given an inside view into radical curricula promoting the left’s agenda for Critical Race Theory, deceptive gender ideology, and sexually explicit content. It was a needed wake-up call.

If there is anything positive to take away from Garland’s Senate appearance, it was his repeated acknowledgment that airing grievances and opposing school board policies are protected forms of speech under the Constitution.  What remains to be seen is how this Administration might weaponize law enforcement to intimidate parents from action if school officials do not like what they hear and want to threaten parents into silence.

Concerned Women for America to DOJ: Knock it Off

Washington D.C. – Penny Nance, President and CEO of Concerned Women for America (CWA), the largest public policy organization for women in the nation, sent the letter below to Attorney General Merrick Garland in response to the October 4 memorandum to the Federal Bureau of Investigation (FBI) and federal prosecutors “to address threats against school administrators, board members, teachers, and staff.”

From the letter:

“However well-intentioned, the practical effect of your memorandum is to violate the most foundational principles of the First Amendment by creating a chilling effect on protected speech by concerned parents over the education of their children… 

“The federal government has no business injecting itself between a mother and the approach to educating her children. There has been no ‘disturbing spike in harassment, intimidation, and threats of violence’ against school officials that would warrant this broad and aggressive step by DOJ and the FBI.”

At a time when anger against the monumental failures of the DOJ and the FBI is at new heights, it is unconscionable that this manufactured emergency is the focus of these departments and using valued and limited resources. Read the letter in full here.

Concerned Women: The FBI is a Disgrace

Washington, D.C. — Concerned Women for America is disgusted and infuriated at the Federal Bureau of Investigation’s (FBI) handling, or lack thereof, of the sexual abuse scandal involving U.S. Olympic Doctor Larry Nasser.

Today’s heart-wrenching testimony from our U.S. gymnasts who represent the best of America has cemented a new low for the once-respected institution, proving them incapable to continue to carry out their oath to the American people. We are calling on a complete clamp down on this out-of-control intelligence agency.

Falsifying documents, which is nothing new for the FBI, is a serious offense for which they must be held accountable. The American people will no longer settle for another internal investigation in which the agency once again vindicates themselves of all wrongdoing. We demand more.

 The FBI continues to make it absolutely clear they cannot be trusted, especially with the most sacred duty of protecting Americans, including our young women, from abuse. CWA stands with these brave women and will continue in our work of fighting to end sexual abuse and exploitation at all levels.

Congress Inquires on FBI’s Targeting of CWA

News of FBI Targeting Concerned Women for America Sparks High Profile Congressional Inquiries

Last month we learned that in 2016, the Federal Bureau of Investigation (FBI) had considered targeting Concerned Women for America (CWA) for an investigation without cause or justification. This revelation, published July 14, 2021, in the Orange County Register, emerged from a Freedom of Information Act (FOIA) request from the Cato Institute. CWA had no awareness of the FOIA request or the case, so when this news broke during the dog days of summer, it was news to us, too.

The article sums up Cato’s discovery with an alarming description of the FBI’s action:

“It was a pure FBI domestic surveillance ‘fishing expedition’ for the digital age, with the agent focused on CWA’s alleged ‘two-star rating’ from Charity Navigator, as well as searches of other commercial and government databases (all conveniently redacted by the FBI).”

The predicate for what was classified as an “Assessment” had no foundation, but neither was it required.  “Unlike a normal FBI investigation,” explains the Cato author, “an Assessment requires no criminal basis to be opened – just the broad and nebulous formulation of an ‘authorized purpose.’” He concludes, “At no time was there an allegation of actual fraud or embezzlement – just an FBI agent looking to meet a quota for how many Assessments they had opened during the reporting period.”

The last five years have shown where a lack of transparency and accountability involving powerful government agencies led by faceless government bureaucrats can lead, especially with then-Director James Comey at the helm. CWA was shocked and disappointed by the unjustified actions of the FBI and the reality that any powerless organization could be the subject of such an act of surreptitious and baseless government action at the cost of American taxpayers.

As CEO and President Penny Nance explained in an opinion piece for Fox News, nothing in CWA’s storied history or our respected work as a public policy organization advocating for the values of conservative women and families would ever warrant such scrutiny. Maybe the very fact we are a notable presence in our nation’s capital had something to do with it.

Our allies on Capitol Hill agreed. That is why the two most powerful Republican elected officials on the U.S. Senate and U.S. House Judiciary Committees have written letters to the chiefs of the U.S. Department of Justice (DOJ) and FBI, Attorney General Merrick Garland and Director Christopher Wray, demanding answers to critical questions about the fishing expedition targeting CWA and a full accounting of other such assessments.

Senate Judiciary Committee Ranking Member Chuck Grassley (R-Iowa) penned a letter to Attorney General Garland and Director Wray on July 20, 2021, asking for details and unredacted information “no later than August 3, 2021”.  We can report that this deadline for responding was not met.

House Judiciary Committee Ranking Member Jim Jordan (R-Ohio) followed with a letter dated August 11 demanding more information about the use of FBI charity assessments and a briefing on our case “as soon as possible but not later than 5:00 p.m. on August 24, 2021.”

Fox News Op-ed: Nance: What I learned from FBI’s ‘assessment’ of me, my organization

Last week, Concerned Women for America (CWA) reported in this press release on the FBI’s unjustified targeting of CWA.

Penny Nance, CWA’s CEO and President spoke out on the FBI targeting in a Fox News op-ed and had this to say, “We should all be worried about the ability and hubris of a politicized FBI to invade and target American citizens and organizations out of favor with those in power … We call on Congress to clamp down on the trampling of our civil liberties using perhaps well-intentioned but overly indulgent rules. The American people deserve better. We demand better.”
