Capitol Hill Brief — Does the Constitution Allow That?

The Trinity Lutheran v. Comer religious liberty case at the Supreme Court exposes the pernicious way some government officials have institutionalized hostility towards religious people under the guise of constitutional requirement.  The state of Missouri tried to avoid the consequences of its arguments, but even the liberal members of the Court pressed on the issues.  Here is Justice Breyer:

[Audio Clip] Justice Stephen Breyer: I’m asking, “Does the Constitution of the United States permit a state or a city to say, ‘We give everybody in this city police protection, but not churches. … We give everybody fire protection, but let the church burn down?”

The answer is “No,” and they know it.
