Another Victory for Life in South Dakota!

The abortion promotions from Mayday Health will no longer be seen at gas pumps in South Dakota.

You likely recall that last December, videos appeared on gas pump screens in South Dakota with the catch line: “Pregnant? Don’t want to be?” This was followed by misleading information about the “safety” of the abortion pills that were available through Mayday Health.

South Dakota Attorney General Marty Jackley responded by sending a cease-and-desist letter to Mayday Health, citing false advertising and noting that abortion is unlawful in South Dakota. Mayday Health claimed the action violated its First Amendment right to free speech and filed a lawsuit in a federal court in New York City.

In February, a federal judge ruled that the case should be heard in South Dakota state court, where it had been scheduled for July 2026.

A settlement has been reached with both sides, and Mayday Health has removed its advertising and promotion of abortion pills.

“My position has been clear and unwavering; South Dakota law governs, and the misleading advertisements must be, and are, stopped,” said Attorney General Jackley.
