CWA of South Dakota has been following the ongoing Mayday Health case challenging the activities of this out-of-state company in promoting the do-it-yourself abortion drug. Be sure to read about Mayday Health’s activities and lawsuits in our recent newsletter. As of that writing, a U.S. District Court ruled in favor of Mayday Health and issued a preliminary injunction stopping enforcement of HB1274. Perhaps you recall that HB1274, passed this year by the South Dakota Legislature, made it illegal to dispense or advertise any items for abortions.
Attorney General Marty Jackley appealed to the U.S. Eighth Circuit Court of Appeals, where the case stands now.
Recently, AG Jackley announced that Attorneys General from 18 states filed an amicus brief (friend of the court) supporting South Dakota’s appeal to the Eighth Circuit. Jackley stated, “I appreciate my fellow Attorneys General who agree that individual states have the right to protect against dangerous pills that don’t meet medical and legal standards. Our states understand the importance of states’ rights and honoring our state law.”

We are grateful that after fifty years of legalized abortion in our country, Roe v. Wade was overturned with abortion decisions returning to the states. However, we all know the battle for life is not over. The advent of the dangerous do-it-yourself abortion drug and the loosening of the drug’s restrictions by the Biden administration during COVID have increased the abortion numbers. This sad reality should encourage us to pray more for the sanctity of life and work to change hearts to respect life.
Let us not become weary in doing good, for at the proper time we will reap a harvest if we do not give up. (Galatians 6:9)
PRAYER: Father, You are the giver of life, our Creator, our Sustainer. We thank You for the overturning of Roe v. Wade, but we are saddened that the killing continues. Help us change people’s minds and hearts so they will respect life and the Giver of life. Please turn the hearts of the Eighth Circuit Court so that our South Dakota law banning the abortion drugs would stand. In Jesus’s name, Amen.
