SCOTUS Agrees States Can Protect Women’s Sports

WASHINGTON, DC – Concerned Women for America (CWA) says that the U.S. Supreme Court decisions in West Virginia v. B.P.J. and Hecox v. Little will help stop biological women from being forced to compete against biological men in women’s sports.

CWA submitted an amicus brief on both cases, arguing that, under Equal Protection, “sex” is not a subjective category divorced from physical, biological reality, so the Court should in no way limit a state’s ability to make laws that comport with that physical reality. CWA filed the first ever civil rights complaint against a college for rostering a male on the women’s team.

“Today, biology wins. It is self-evident that males and females are biologically different, and the U.S. Supreme Court has confirmed this truth. These fundamental differences are why we reasonably separate sports based on sex. The fact that biological women have had to compete against biological men is inherently unjust. We are grateful that the Supreme Court agrees,” said Penny Nance, CEO and President, Concerned Women for America.

“It is fundamentally unfair for a male who feels like a female to demand that biological categories be ignored to accommodate his desire to compete among females. The Court rejected the idea that states seeking to protect women’s sports are discriminating against transgender individuals. This is about protecting females and biological reality. We are glad the Court saw right through the left’s charade,” she said.

CWA research from July 2025 found that trans-identifying males have stolen over 1,941 gold medals from women and girls in the United States; additionally, trans-identifying male athletes have stolen over $493,173 in prize money from women in professional sports.
