Sen. Erin Grall (R–District 29) refiled legislation that would allow Florida parents to recover civil damages for the wrongful death of their unborn child.
Parents who suffer the loss of an unborn child due to wrongful acts by a third party could soon have the right to seek civil compensation for their loss. This pro-life legislation, SB 164, was refiled in October 2025 after previous versions stalled in the Senate during the 2024 and 2025 sessions, largely due to opposition from the insurance industry.
The amended bill expands protections for grieving parents by:
- Allowing parents of unborn children to recover civil damages for wrongful death.
- Clearly defining “unborn child.”
- Prohibiting any right of action against the mother or medical professionals providing lawful care consistent with medical standards.
- Permitting recovery of damages for mental anguish after the loss of an unborn child.
On November 4, 2025, the Senate Judiciary Committee voted 5-4 in favor of SB 164. The bill is now in the Appropriations Committee on Criminal and Civil Justice for further review.
