Several members have written, asking about the status of the marriage cases at the U.S. Supreme Court. It seemed for a while that we were close to hearing from the Court on whether it would take any cases on California’s Proposition 8 and also on the Defense of Marriage Act (DOMA) at the federal level.
We saw reports that they would be considering them in a September 24 conference, just to hear later that they were not going to do that, opting to wait for all the briefs to be submitted. More speculation/confusion followed.
The latest information we have is that the Justices will consider whether to take the cases on their conference scheduled for November 20. That means we will likely hear which cases they will take, if any, by the end of the month.
Some commentators argue they were just trying to get past the election. We have no information confirming that, and we certainly hope such is not the case. This is a legal matter for the courts to consider and not a political one.
