Concerned Women for America Celebrates Supreme Court Decision Upholding Tennessee’s Law in United States v. Skrmetti

Washington, D.C. – Concerned Women for America (CWA), the nation’s largest public policy women’s organization, applauds the U.S. Supreme Court’s 6-3 decision in United States v. Skrmetti, upholding Tennessee’s Senate Bill 1 (SB1). This landmark ruling affirms a law protecting minors from irreversible gender-affirming medical procedures, reinforcing the state’s authority to safeguard the health and well-being of its young citizens.
The Court’s decision confirms that a state’s efforts to protect children who struggle with identity issues from life-altering and irreversible procedures in this way does not violate the Equal Protection Clause of the Fourteenth Amendment. This ruling sets a critical precedent, supporting the rights of states to protect children.
In the majority opinion, Chief Justice John Roberts emphasized the Court’s limited role in resolving policy disputes, stating:
“This case carries with it the weight of fierce scientific and policy debates about the safety, efficacy, and propriety of medical treatments in an evolving field. The Equal Protection Clause does not resolve these disagreements. The Court’s role is not ‘to judge the wisdom, fairness, or logic’ of SB1, but only to ensure that the law does not violate equal protection guarantees. It does not. Questions regarding the law’s policy are thus appropriately left to the people, their elected representatives, and the democratic process.”
